Malaysian Law (edited - last part)
Section 499 of the Penal Code provides for the offending act on defamation. The other is the cyber laws. Some people are just too dumb to leave proof around to get screwed.Maybe you guys should read it before posting things which aren't true about someone. This goes particularly when you actually name that person by name or nickname. Things on the internet can't be removed that easily mind you because some would stood there for years and they might be back to haunt you. Cross the line then be prepared to face the consequences. Some people just like to play it big and they stand to lose out big under this act.
Under Communications and Multimedia Act 1998, I think paying 1k in fine for everyday could be a small amount for someone(that's if you have the money to dump into the dustbin). I got this from a lawyer friend. I also found out that US laws(which most blog sites are from) are tough on all these too and under their law, they are complied to give a copy of the original post(if deleted or modified in any way) I leave you to your thought. “Section 499. Defamation
Whoever, by words either spoken or intended to be read or by signs, or by visible representations makes or publishes any imputation concerning any person, intending to harm, or knowing or having reason to believe that such imputation will harm the reputation of such person, is said, except in the cases hereinafter excepted, to defame that person.
Section 500. Punishment for defamation
Whoever defames another shall be punished with imprisonment for a term which may extend to two years, or with fine, or with both.”
Section 211 and Section 233 of the Communications and Multimedia Act 1998 provides for the prohibition of offensive content and improper use of network facilities and network services.
Communications and Multimedia Act 1998 (Act 588)
“Section 211. Prohibition on provision of offensive content
No content applications service provider, or other person using a content applications service, shall provide content which is indecent, obscene, false, menacing, or offensive in character with intent to annoy, abuse, threaten or harass any person.
A person who contravenes subsection (1) commits an offence and shall, on conviction, be liable to a fine not exceeding fifty thousand ringgit or to imprisonment for a term not exceeding one year or to both and shall also be liable to a further fine of one thousand ringgit for every day or part of a day during which the offence is continued after conviction.”
“Section 233. Improper use of network facilities or network service, etc.
A person who by means of any network facilities or network service or applicationsservice knowingly —
- makes, creates or solicits; and
- initiates the transmission of, any comment, request, suggestion or other communication which is obscene, indecent, false, menacing or offensive in character with intent to annoy, abuse, threaten or harass another person;
or initiates a communication using any applications service, whether continuously, repeatedly or otherwise, during which communication may or may not ensue, or withwithout disclosing his identity and with intent to annoy, abuse, threaten or harass any person at any number or electronic address, commits an offence.”

I just found out something new. Blogs are considered as written proofs too and when things are put on blogs, even when they are not yours (eg posting conversations), you are still liable if those things in the post is defamatory (you have to prove it's right in court and failure to do so would make you guilty). This is because the person posted it and the last I checked posting something about people's sexual preference which is untrue is also considered defamatory. Ever wondered why people post things which are not theirs and worse still is the person they get the information from are not those directly involved and doesn't know much about what actually happened?
It would also be fun to get a friend's(Ezra Wong) mum(Mrs. Wong), who is the senior assistant of the said school(PESS) to testify in court that what is being said are lies. Things are indeed getting interesting. Some would never know what happened at the office and give their own version of things. Anyway I wish your friend and the one who loves to get "good" stories about me good luck. A police report was made (that I do not deny and it's not one but two actually but against who and what happened in the process of investigation?). Why is it I am still here and not convicted if I did indeed make threats? For goodness sake, get your facts clear before you try to throw your own poo at others.
"Weird Bulletins"? Maybe they are weird because as far as I can remember, I don't think I posted much bulletins except a few which I am 100% sure had nothing to do with anyone. Actually the police reports coincides with both my exam dates. Wanna put a bet on who is cooking up stories now? Posters? What a laugh. What posters can I post? Luckily there are people who did investigate to the end and not like some who just start the mud slinging thinking she know it all. You know there is this Chinese proverb which says "Jou meh dou hou, lau fan yat di yue bei bei ji gei"(in whatever you do, always leave some means of escape for your own). It means that in life you need not always go all out as at time when you lose it, you would lose it all. I hope you would really see things clearly.
Right now I don't have the time to deal with you. You can continue to dig your own grave hole there and when I have the time and I feel like it, I would make sure you get back what you deserve. I don't make empty promises and when I say this out, I mean it. It would be fun to see lawyers grilling your friend as she isn't even sure of things when she said them out. My advice? When you want to dig up poo, make sure you are ready to get yourself covered in them too because that is what you are going to get if you fail. Happy now? I am just waiting for you to cook up more stories about me so when you fall, you would surely fall hard.
